Enroco Technologies Private Limited is the owner of the brand name 'SNUGSQUARE' and owns and operates the domain www.snugsquare.com ("Website").

SnugSquare offers this Platform (defined below), including all content, information, tools and services available on this Platform to you, the user, subject to your acceptance of all terms, conditions, policies and notices stated here.

ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORM INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING.

It is strongly recommended that you read and understand these Terms of Use ("Terms") carefully, as by accessing the Platform; you agree to be bound by the same and acknowledge that it constitutes a binding agreement between you and SnugSquare ("Agreement”). If you do not agree to the Terms, you should not use or access the Platform for any purpose whatsoever.

By visiting our Platform, You agree that you are lawfully competent and authorized to enter into this Agreement including terms, conditions, obligations, representations and responsibilities set forth in these Terms which may be amended from time to time, and to abide and comply with these Terms.

Definitions

“Buyer” shall mean and include any legal person, entity or users, who intends to purchase Products or purchases any Products, using the Platform.

“Order” shall mean an order placed by the User, for procuring or buying the Products, through the Platform and shall be specifically designated by an order number which can be used by you or us for obtaining details about the order including without limitation details of the status of such order.

“Product(s)” shall mean and include all items listed on the Platform for sale, including but not limited to furniture, curtains, upholstery etc.

“Platform” shall mean the website, or any other medium through which we allow you to view or purchase the Products.

“User/user”, “You/you”, “Your/your” means any natural or legal person who visits, browses, accesses or uses the Platform.

“Use” or “Using” means to browse, access, view, avail services or other benefits from using the Platform.

“We”, “Company”, “Us”, “Enroco” or “Our” or “SnugSquare” means Enroco Technologies Private Limited and its affiliates, officers, employees, agents, partners and licensors.

Updation of Terms

These Terms may be updated, amended, modified or revised by us from time to time. Each such updation or modification to the Terms will require you to give separate explicit consent with respect to each such revised version to be able to continue to use the Services. As a best practice, we encourage you to refer to these Terms from time to time to ensure that you are aware of any additions, revisions, amendments or modifications that we may have made.

Access to the platform

We will do our utmost to ensure the availability of the Platform is uninterrupted and that the transmission is error-free. However, due to the nature of the internet, this cannot be guaranteed.

Also, your access to the Platform may be occasionally suspended or restricted to allow for repairs, maintenance or the introduction of the new facilities or services at any time without prior notice.

You may be required to register with us and create an account for purchasing Products from our Platform. For the purpose of registering and creating an account on the Website we may collect certain information from you which may be personal in nature. Kindly read through our privacy policy to understand how do we collect, use, protect and handle information provided by you.

Account and Registration Obligations

If you use this Platform, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your personal device to prevent unauthorized access to your account.

You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have reasons to believe that your password has become known to anyone else, or if the password is being, or is likely to be used in an unauthorized manner.

You can access and update much of the information you provide through your account. You agree and acknowledge that you will use your account on the Platform to purchase Products only for personal use and not for business purposes. SnugSquare reserves the right to refuse access to the Platform, terminate accounts, remove or edit content at any time without notice to you.

As part of the registration process on the Platform, we may collect the following personally identifiable information about you: name including first and last name, email address, mobile phone number, contact details, postal details, demographic profile (like your age, gender, occupation, address etc.)

Further SnugSquare may allow the Users to register and log into their accounts through third party accounts such as Facebook or Google.

Eligibility

Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 and undischarged insolvent etc. are not eligible to use/access the Platform.

However, if you are a minor i.e. under the age of 18 (eighteen) years, you may access the Platform under the supervision of an adult parent or legal guardian who agrees to be bound by these Terms. You are however prohibited from purchasing any Product(s) which is for adult consumption, the sale of which to minors is prohibited.

SnugSquare, in its sole discretion and without any liability, reserves the right to terminate or refuse your registration, or refuse to permit use/access to the Platform, if:

  • - it is discovered or brought to the notice to you do not conform to the eligibility criteria; or

  • - SnugSquare has reasons to believe (including through evaluation of usage patterns) that the eligibility criteria is not met; or

  • - there is a breach of the Terms.

License & Platform Access

SnugSquare grants you a limited, non-transferable, license to access and make personal use of the Platform and not to download (other than page caching) or modify it, or any portions of it, except with written consent of SnugSquare.

The license does not include any right to resale or right to make commercial use of this Platform or its contents including but not limited to:

  • - any collection and use of any Product listings, descriptions, or prices;

  • - any derivative use of the Platform or its contents; any downloading or copying of account information for the benefit of another merchant;

  • - or any use of data mining, robots, or similar data gathering and extraction tools.

This Platform or any portion of the same may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of SnugSquare. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of SnugSquare and its affiliates without express written consent. You may not use any meta tags or any other "hidden text" utilizing the Platform’s name or trademarks without the express written consent of the Company. Any unauthorized use terminates the permission or license to use the Platform.

You shall not attempt to gain unauthorized access to any portion or feature of the Platform or any systems or networks connected to the Company, by hacking, crawling, scraping, ‘password-mining, or any other means.

You hereby agree and undertake not to host, display, upload, modify, publish, transmit, update or share any information that:

  • - belongs to another person and to which you do not have any right;

  • - is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever;

  • - harms minors in any way;

  • - violates any law for the time being in force;

  • - deceives or misleads the addressee about the origin of such messages communicates any information which is grossly offensive or menacing in nature;

  • - impersonates another person;

  • - contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource;

  • - threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation;

  • - is misleading or known to be false in any way.

Any unauthorized use shall automatically terminate the permission or license granted by the Company.

User-Generated Content

From time to time, the Platform permits the submission of content, such as comments, blogs and product reviews, generated by you and other users ("User Content").

You are solely responsible for your own User Content and the consequences of posting or publishing it. Any User Content or other material, information or ideas that you submit to or post or publish on the Platform is non-confidential and non-proprietary.

By submitting User Content, you represent and warrant to SnugSquare that: (i) your User Content does not violate any copyright, trademark, trade secret, patent or other intellectual property right, any right of privacy or publicity of any third party or any applicable law, rule or regulation, (ii) you own or have the legal right to use and authorize SnugSquare to use your User Content, including written consent to use of any product or the name, voice, likeness or any other applicable personal rights of each identifiable person featured or referenced in your User Content and (iii) your User Content does not violate SnugSquare’s Acceptable Use Policy set forth below.

As between you and SnugSquare, you will retain all of your ownership rights in and to your User Content. By submitting User Content on the Platform, you hereby grant to SnugSquare a perpetual, worldwide, non-exclusive, irrevocable, royalty-free, sub-licensable (through multiple tiers) and transferable right and license to use, reproduce, distribute, edit, modify, translate, reformat, prepare derivative works based upon, display publicly, perform publicly and otherwise exploit (including but not limited to over the Internet, broadcast television or any other uses or media) your User Content, in whole or in part, including future rights that SnugSquare (or its successor) may otherwise become entitled to that do not yet exist, as well as new uses, media, means and forms of exploitation throughout the universe exploiting current or future technology yet to be developed. You also hereby grant each user of the Platform a non-exclusive license to access your User Content through the Platform and to use, access, watch, reproduce, distribute, transmit, forward, display and perform such User Content in whole or in part, to the extent permitted by the Platform under these Terms.

SnugSquare does not endorse any User Content or any opinion, recommendation, or advice expressed therein. SnugSquare reserves the right but is not obligated to monitor User Content or other content sent to or FTC through the Platform. SnugSquare has the right to refuse, remove, edit or delete any User Content and/or to terminate any user's access to the Platform for any reason. SnugSquare takes no responsibility for User Content.

Reviews and Feedback

All reviews, comments, feedback, suggestions, ideas, and other submissions disclosed, submitted or offered to the Platform or submitted or offered in connection with your use of this Platform (collectively, the "Comments") shall be and remain the property of SnugSquare. Such disclosure, submission or offer of any Comments shall constitute an assignment to SnugSquare of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the Comments. Thus, SnugSquare owns exclusively all such rights, titles and interests and shall not be limited in any way in its use, commercial or otherwise, of any Comments. SnugSquare will be entitled to use, reproduce, disclose, modify, adapt, create derivative works from, publish, display and distribute any Comments you submit for any purpose whatsoever, without restriction and without compensating you in any way. SnugSquare is and shall be under no obligation (a) to maintain any Comments in confidence; (b) to pay you any compensation for any Comments; or (c) to respond to any Comments. You agree that any Comments submitted by you to the Platform will not violate these Terms or any right of any third party, including copyright, trademark, privacy or other personal or proprietary right(s), and will not cause injury to any person or entity. You further agree that no Comments submitted by you to the Platform will be or contain libellous or otherwise unlawful, threatening, abusive or obscene material, or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any form of "spam". SnugSquare does not regularly review posted Comments, but does reserve the right (but not the obligation) to monitor and edit or remove any Comments submitted to the Platform. You grant SnugSquare the right to use the name that you submit in connection with any Comments.

Acceptable Use Policy

By submitting User Content and otherwise using the Platform, you agree not to: (i)submit any User Content that is protected by or otherwise subject to any third party intellectual property or proprietary rights (including any privacy and publicity rights) unless you own or have permission from the rightful owner of such rights to post such User Content and to grant SnugSquare all of the rights granted herein; (ii)upload, post, e-mail or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, hateful or racially, ethnically or otherwise objectionable; (iii)use the Platform to harm any person or entity, including SnugSquare; (iv)impersonate any person or entity, including but not limited to, a representative of SnugSquare, or falsely state or otherwise misrepresent your affiliation with a person or entity; (v)forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted to or through the Platform; (vi)upload, post, e-mail or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, junk mail or any other form of solicitation; (vii)upload, post, e-mail or otherwise transmit any content that contains computer viruses or other computer code, files or programs that interrupt, destroy or limit the functionality of the Platform or any other computer software or hardware or telecommunications equipment; (viii)intentionally or unintentionally violate any applicable local, state, national or international laws, rules or regulations, including but not limited.(ix)collect, store or use personal information about other users of the Platform without their consent; (x)use the Platform (including through submission of User Content) to disparage or make unsubstantiated claims about any person, third party or its/their products or services; (y)use any of the Platform in any manner that could overburden or impair any of the Platform or the networks or systems connected to the Platform; and/or (z)use any device, software or instrumentality to interfere with the proper working of the Platform or disobey any requirements, procedures, policies or regulations of networks connected to the Platform.

You also agree that you will not violate or attempt to violate the security of the Platform. Violations of system or network security may result in civil or criminal liability. Platform reserves the right to investigate occurrences which may involve such violations and may involve and cooperate with, law enforcement authorities in prosecuting users who have participated in such violations.

Data Ownership and Intellectual Property Claims

All the content included in this Platform including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software is the property of SnugSquare and its affiliates and is protected by laws of India. All software used in this Platform is the property of SnugSquare, its affiliates and is protected by India’s copyright laws.

You may not extract or re-utilize parts of the contents of the Platform without SnugSquare’s written consent.

The Company and its affiliates respect the intellectual property of others. If you believe that your intellectual property rights have been used in a way that gives rise to concerns of infringement, please write to us at the contacting us section mentioned below.

Pricing

All the Product(s) listed on the Platform will be sold at the price listed unless otherwise specified. Although prices of most of the Product(s) do not fluctuate on a daily basis but prices of some of the commodities or items may change. Further all the Product(s) listed on the Platform confirm to the requirements under the applicable laws.

Order Acceptance

The receipt of an order number or an email order confirmation does not constitute the acceptance of an order or a confirmation of an offer to sell. SnugSquare reserves the right, without prior notification, to limit the order quantity on any item and/or to refuse service to any Buyer. Verification of information may be required prior to the acceptance of an order. Prices and availability of products on the Platform are subject to change without notice. Errors will be corrected when discovered and SnugSquare reserves the right to revoke any stated offer and to correct any error, inaccuracy, or omission (including after an order has been submitted). SnugSquare reserves the right, at its sole discretion, to refuse or cancel any order for any reason. Your account may also be restricted or terminated for any reason, at SnugSquare’s sole discretion.

Delivery

SnugSquare does not guarantee the delivery of the Product(s) on the delivery date or time as specified while ordering Products where such delay arises due to any unforeseeable or unavoidable circumstances including but not limited to events beyond our reasonable control. You can choose to get the Product delivered on any next available delivery date. In an event where the Product delivery is delayed or is returned from its destination on account of a mistake by the Buyer (For example- providing the wrong name or address or other incorrect/misleading information), any additional costs incurred by SnugSquare for re-delivery of the Product(s) shall be borne by the Buyer. Further SnugSquare shall not be held liable for any delay in the delivery of the Product(s).

Payment

You as a Buyer understand that upon initiating a transaction you are entering into a legally binding and enforceable contract with SnugSquare to purchase the Products from SnugSquare using the payment facility, and you shall pay the transaction price through your issuing bank to SnugSquare through any other medium acceptable to SnugSquare.

SnugSquare reserves the right to refuse to process transactions by Buyers with a prior history of questionable charges including without limitation breach of any agreements by Buyer with SnugSquare or breach/violation of any law or any charges imposed by issuing bank or breach of any policy.

SnugSquare may do such checks as it deems fit before approving the receipt of/Buyers commitment to pay(for cash on delivery transactions) transaction price from the Buyer for security or other reasons at its discretion. As a result of such check, if SnugSquare is not satisfied with the creditability of the Buyer or genuineness of the transaction or other reasons at its sole discretion, SnugSquare shall have the right to reject the receipt of / Buyers commitment to pay transaction price.

The Buyer acknowledges that SnugSquare will not be liable for any damages, interests or claims etc., resulting from not processing a transaction/transaction price or any delay in processing a transaction/transaction price which is beyond control of SnugSquare.

Title to the Products and Risk of Loss

Title to the Products ordered by you passes to you upon delivery of such Products to you. Risk of loss to any and all Products ordered you passes to you upon receipt of such Products by you.

References on this Platform to any names, marks, Products or services of third parties or hypertext links to third party Platform or information are provided solely for your convenience and such references do not in any way constitute or imply the Platform’s endorsement, sponsorship or recommendation of the third party information, product or service.

SnugSquare is not responsible for the content of any third party Platform and does not make any representations regarding the content or accuracy of material on such third party websites or platforms. If you decide to visit the link to any such third party website or platform, you do so entirely at your own risk.

Cashback

  • A User shall be entitled to cashback on a specific purchase/Order as indicated at the time of checkout of the Order on the Platform.

  • Cashback shall not be available for the Orders which are cancelled. Any cashback offered may be recovered by SnugSquare, without notice to the User.

  • Cashback shall mean the grant of credit for the amount of eligible cashback, which shall be added to the cashback section of the User’s wallet integrated with its registered account on the Platform. In no event shall the cashback be credited to a User’s bank account or refunded in cash at any time.

  • Cashback offers may not be clubbed with any other offers and cannot be assigned or transferred to any other User.

  • Company reserves the right to, without liability or prejudice to any of its rights, at any time, without previous notice from time to time, withdraw/amend/cancel the cashback offers and the terms applicable thereto.

  • Cashback will reflect in the User’s wallet once the order has been shipped.

  • Cashback shall expire after duration of 12 (twelve) months from last Order unless specified or added through a separate campaign, which may be subject to a shorter expiry time.

Wallet Terms And Conditions

By using the Wallet you hereby agree to these T&C's and shall always abide by them while using the Wallet on the Platform. The Wallet is provided by Enroco Technologies Private Limited (“Enroco”). The customers using the Wallet may load amounts in the wallet through their credit or debit cards and the amounts in the Wallet may be used for making payments towards transactions done by customers on the Platform. You shall not be permitted to make any withdrawals from the Wallet. By registering for or using Wallet, you represent and warrant that you have the right, authority and capacity to accept these T&C's and to abide by the T&C's. The Wallet is a pre-paid payment instrument which is associated with your Platform account (as governed under the Platform terms of use). You can redeem the balance in your Wallet at your convenience on the Platform. Any capitalised term which is not defined under these T&C's but used herein shall bear the same meaning as ascribed to them in the Platform terms of use.

  • Eligibility

    The Wallet services are provided and made available by Enroco only to individuals who are above the age of 18. By accepting these T&C's and by using the Wallet services you hereby represent and confirm that you are above the age of 18 and have not been previously suspended or removed by Enroco to use the Wallet services. Where an individual is not above the age of 18 and has been suspended or removed previously by Enroco from using the Wallet, then he/she should stop using the Wallet and refrain himself/herself from using the Wallet in future. In addition, you represent and warrant that you have the right, authority and capacity to enter into these T&C's and to abide by all the T&C's. Finally, you shall not impersonate any person or entity, or falsely state or otherwise misrepresent your identity, age or affiliation with any person or entity. Finally, in the event of any violation of the T&C's, Enroco reserves the right to suspend or permanently prevent you from availing Wallet or using the Platform.

  • Refund of Wallet Amount

    We may provide you with certain refunds and cash-backs depending on your use and transaction on the Platform. Your Wallet may be refilled as listed below:

    • Credit: This amount is credited to your Wallet in lieu of a cancelled or incorrect order.

    • Discounts and cashbacks: We may credit your Wallet with certain discounts and cashbacks as provided by us on our Platform.

  • General Conditions for Wallet

    • To avail all the services of the Wallet and to have a hassle-free experience you may be required to register/create a user account on the Platform.

    • You are not allowed to add money to the Wallet through online payment methods as recognised in India. You will not be allowed to use any cards or accounts or payments methods which are not accepted by the Platform and are not allowed/recognised in India or are illegal in India.

    • Enroco under no circumstances will not be obligated to refund any money that has been added by you in the Wallet back to your registered bank account.

    • You are not allowed to withdraw money from your Wallet. The balance/outstanding credit in the Wallet should only be used for transactions taking place on the Platform.

    • Enroco shall have the right to suspend/discontinue your use of the Wallet services, for any cause, including but not limited to the following:

      • For any unauthorized or illegal use of the T&C's or any such use of the Wallet which is in violation of these T&C's.

      • To prevent or combat any potential breach of security of the Wallet services or to curb or prevent any fraud, unauthorised access or any other force majeure event.

      • If the same is due to technical failure, modification, upgradation, variation, relocation, repair, and/or maintenance due to any emergency or for any technical reasons;

    • The value stored in your Wallet on the Platform is interest-free and you hereby agree and acknowledge that Enroco is not obligated to pay you any interest on the amount deposited by you in the Wallet.

    • You are only allowed to maintain and operate one single Wallet at a time through your registered account on the Platform.

    • Any operation of or continued availability of any facility respect to the Wallet service is subject to any requirements under applicable laws, and any new regulations or directions from any regulatory authorities in India.

    • Enroco does not endorse, promote or warrant any goods and/or services that might be bought/availed or proposed to be bought/availed using Wallet.

  • Wallet Validity

    The Wallet shall remain valid and active at all times unless suspended or discontinued by us. However, in case no transaction that has occurred through the Wallet on the Platform for more than 12 months then in such cases your use of the Wallet will be fortified and restricted.

  • Customer Obligations

    • You should ensure that all the resources and equipment required to use the Wallet and the Wallet services are available with you at all times. Wallet availability is subject to the maintenance of the required resources and equipment and other application on which Platform can run and you are solely responsible for all liability arising from unavailability of the Platform due to a deficient resource or the internet service provider not being able to support any Wallet channel or application.

    • It's your responsibility to maintain the safety, integrity and security of your Wallet. Enroco has put in place numerous safeguards to ensure that no third party can have an unauthorised access to your Wallet but Enroco does not guarantee complete safety or security of the Wallet. You must ensure that your registered Wallet login id and password are confidential in nature and shall be disclosed to any third party.

    • Prior to any transaction you must ensure that you have sufficient money/amount in your Wallet for completion of any transaction.

    • Any information that you may provide for the purposes of registration for the use of Wallet shall be true and correct.

  • Limitation of Liability

    In no event will Enroco will be liable for any money which is added or is made part of your Wallet as per these T&C's. Enroco shall not be liable for any special, incidental, indirect or consequential damages or losses of any kind, arising from the use of Wallet or association with the Wallet.

Return/Replacement and Refund Policy

For any return, refund or cancellation of Product purchased or amount paid through the Platform, please refer to the SnugSquare’s return, refund and cancellation policy.

Objectionable Material

You understand by using this Platform or any services provided on this Platform, you may encounter content which may be deemed to be offensive, indecent, or objectionable, which content may or may not be identified as such.

Please notify us immediately by writing to us at the address provided in the Contacting Us section mentioned below if you come across any objectionable content. Once this procedure has been followed, SnugSquare will make reasonable endeavours to remove such objectionable content complained about within a reasonable time.

Indemnification

You shall indemnify and hold harmless SnugSquare, its subsidiaries, affiliates and their respective officers, directors, agents and employees, from any claim or demand, or actions including reasonable attorney’s fees, made by any third party or penalty imposed due to or arising out of your breach of these Terms or any document incorporated by reference or violation of any laws, regulations or the rights of any third party.

Limitation of Liability

The aggregate liability of SnugSquare, if any, that is established and ordered by a court of competent jurisdiction pursuant to a claim, shall in no event exceed the price of the Product charged from a User for purchases made pursuant to an Order under which such liability has arisen or has been established.

SnugSquare shall not be liable for any illness or injury suffered by a Buyer, arising out of consumption/usage of a Product.

SnugSquare will not be responsible for any indirect or consequential loss regardless of the form of action or the theory of recovery.

  • SNUGSQUARE, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS MAKE NO REPRESENTATION AND WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO (I) ANY REPRESENTATION OR WARRANTY AS TO THE SPECIFICS (SUCH AS QUALITY, VALUE, ETC.) OF THE PRODUCT(S) SOLD OR PROPOSED TO BE SOLD ON THE PLATFORM. (II) ANY EXPECTATION OF THE USERS WITH RESPECT TO THE PRODUCTS. (III) ANY REPRESENTATION OR WARRANTY RELATED TO PROVISION OF UNINTERRUPTED, TIMELY, SECURE, ACCURATE OR ERROR-FREE SERVICES.   • SNUGSQUARE, ITS ASSOCIATES, AFFILIATES AND SERVICE PROVIDERS AND TECHNOLOGY PARTNERS MAKE NO REPRESENTATIONS OR WARRANTIES ABOUT THE ACCURACY, RELIABILITY, COMPLETENESS, AND/OR TIMELINESS OF ANY CONTENT, OR INFORMATION/DECLARATIONS PROVIDED BY THE MERCHANTS FOR THEIR PRODUCTS PURSUANT TO COMPLIANCE UNDER THE APPLICABLE LAWS, INFORMATION, SOFTWARE, TEXT, GRAPHICS, LINKS OR COMMUNICATIONS PROVIDED ON OR THROUGH THE USE OF THE PLATFORM OR THAT THE OPERATION OF THE PLATFORM WILL BE ERROR FREE AND/OR UNINTERRUPTED. INFORMATION REGARDING THE PRODUCT(S), PRICING, CONTENT, MAY BE INCORRECTLY REFLECTED ON THE PLATFORM DUE TO SOME TECHNICAL ISSUE, TYPOGRAPHICAL ERRORS OR PRODUCT INFORMATION. IN SUCH AN EVENT THE COMPANY HAS A RIGHT TO CANCEL THE ORDER PLACED BY THE BUYER.

  • THE PLATFORM MAY PROVIDE CERTAIN SUPPORT SERVICES TO FACILITATE THE TRANSACTIONS BETWEEN SNUGSQUARE AND USERS OF THE PLATFORM AND SUCH INDEPENDENT SERVICES MAY INCLUDE LISTING MANAGEMENT, WAREHOUSING SERVICES, LOGISTICS SERVICES, MAKING AVAILABLE COURIER SERVICES AND PAYMENT FACILITATION THROUGH NODAL BANK(S) OR CERTIFIED PAYMENT GATEWAYS UNDER APPLICABLE LAWS. YOU UNDERSTAND, AGREE AND ACKNOWLEDGE THAT THE PLATFORM WILL ENGAGE INDEPENDENT THIRD PARTY SERVICE PROVIDERS TO PERFORM THESE SERVICES. THE USERS MAY BE ABLE TO AVAIL CERTAIN SERVICES THROUGH THE PLATFORM WHICH ARE PROVIDED BY THIRD PARTIES, AND SUCH SERVICES SHALL BE GOVERNED BY SUCH THIRD PARTY’S TERMS AND CONDITIONS. ANY LIABILITY ARISING IN THIS CASE SHALL REST WITH SUCH THIRD PARTIES AND NOT THE COMPANY.

  • THE PLATFORM MAY ON REASONABLE EFFORTS BASIS PROCURE ORDINARY INDUSTRY STANDARD WARRANTIES FROM THESE THIRD PARTIES. YOU FURTHER UNDERSTAND, AGREE AND ACKNOWLEDGE THAT THE PLATFORM WILL NOT BE HELD LIABLE OR RESPONSIBLE TOWARDS YOU OR TOWARDS ANY PERSON CLAIMING UNDER OR THROUGH YOU FOR ANY ACTIONS, COMMISSION, OMISSION, MISCONDUCT, FRAUD OR NEGLIGENCE (WHETHER IN CONTRACT OR TORT OR UNDER PUBLIC POLICY) OF THESE THIRD PARTIES UNLESS SUCH ACTIONS, COMMISSION, OMISSION OR NEGLIGENCE OF THE THIRD PARTY IS ATTRIBUTED TO A DIRECT CAUSE OF MISCONDUCT AND GROSS NEGLIGENCE OF THE PLATFORM AND IN SUCH AN EVENT THE TOTAL AGGREGATE LIABILITY OF SNUGSQUARE SHALL BE LIMITED TO THE EXTENT PROVIDED IN THE CLAUSE TITLED "LIMITATION OF LIABILITY" IN THESE TERMS.

You agree that the aforesaid disclaimers shall be in addition to any other disclaimers given in these Terms.

Communications

When you visit the Platform you are communicating with us electronically. You will be required to provide a valid phone number while placing the order with us. We may communicate either by e-mail, SMS, phone call or by any other modes of communication.

For contractual purposes, you have consented to receive communication from us with respect to your use of the Platform, any Order placed (or in the process of being placed) and communications for promotional purposes.

Events beyond our reasonable control

We will not be responsible for any delay or failure to comply with any obligations under these Terms of Use, if the delay or failure arises from any cause which is beyond our reasonable control.

Waiver

If you breach these conditions and we take no action it shall not be construed as a waiver and we will still be entitled to use our rights and remedies in any other situation where you breach these conditions.

Compliance with Laws

You hereby agree and acknowledge that while accessing the Platform, or placing any Order(s) on the Platform or while purchasing any Products from the Platform you will comply with all the applicable laws. You understand and agree that SnugSquare shall not be liable for any non-compliance of the applicable laws by you. You hereby agree to indemnify SnugSquare against any claims, damages or charges made against SnugSquare due to such non-compliance of applicable laws by you.

Governing Law, Jurisdiction and Dispute Resolution

These Terms shall be construed in accordance with the applicable laws of India, without giving effect to any choice of law or conflict of law rules or provisions. Any dispute or difference related to these Terms shall be subject to the exclusive jurisdiction of the courts in Bangalore.
